Usufructuary right

It is often agreed upon when a property is given away - e.g. by parents to their children. Usufruct is a right for life that is entered in the land register. The donor becomes the usufructuary. It assures the usufructuary to continue to use or dispose of the property as the owner can. Renting and collecting rent is also possible. However, sale or wanton destruction is excluded. The legal basis of usufruct is § 1030 BGB (only in German). Usufruct should always be recorded in a contract and notarized. The usufructuary right is then entered in the land register
